PaolosGelatoGourmet.com is a division of Smiling Consultants, Inc., a registered company in the US State of Georgia. The PaolosGelatoGourmet.com website (the "Site") is an online information service provided by PaolosGelatoGourmet.com, subject to the terms and conditions set forth below.

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCESSING OR USING THE SITE. BY ACCESSING OR USING THE SITE, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. SATISFACTION GUARANTEE
Our goal is to give our customers the highest level of service possible, and we recognize that it is essential that our customers can shop knowing that their well-being is protected. We have a staff of professionals here at PaolosGelatoGourmet.com who is absolutely committed to delivering a happy and pleasant experience to each and every one of its customers. We consider it a privilege to have an opportunity to serve our customers, and we do not take lightly the responsibility of fulfilling orders in an accurate, timely fashion.
Have confidence when you order from us. If you are not satisfied with any item you order from us, you may return it within 30 days from the date of receipt for future purchase credit or for a refund. We guarantee you will be satisfied with the quality of the product you ordered, or your money back in full. If you receive your order, and you simply change your mind about wanting the product, you may return it but you will not be refunded the shipping charges and you will responsible for a 15% re-stocking fee. Returned merchandise must include all original packaging and paperwork, and must be packaged properly so as to avoid shipping damage. Shipping charges cannot be refunded unless it is evidenced that the part(s) are defective or that we made an error in fulfillment of the order. ORDER PROCESSING
PaolosGelatoGourmet.com is proud to have a SAME DAY SHIPPING policy for all orders received and payment processed before 1:00 p.m. (Eastern Time Zone), Mon – Fri. Some orders may require 1-2 business days prior to shipping. Orders are not processed on weekend days. Though we have a SAME DAY SHIPPING policy, PaolosGelatoGourmet.com does not guarantee same day shipping. PaolosGelatoGourmet.com reserves the right to decline any order. Prices listed on our site do not include shipping and/or delivery charges. Unless otherwise requested, delivery will be by FedEx Ground and customer agrees to the charges being added to the order.

Online Orders:

By placing an order on the site, the customer agrees to the terms and conditions of sale, constituting a binding contract between the customer and PaolosGelatoGourmet.com.

By Mail:
Instead of transmitting your order online, you can print it out and mail it to us. Please be sure to sign the order form somewhere. Include credit card number (Visa, MasterCard, or American Express) and expiration date, or one of the following forms of payment: Personal Check, Traveler's Check, or Money Order, made out to PaolosGelatoGourmet.com. Note: Personal checks must have your name and address pre-printed on them and may delay shipping of your order by up-to 10 business days for clearing through the bank system.

RETURNS & DAMAGED PRODUCTS
If you are not satisfied with any item you order from us, you may return it within 30 days from the date of receipt for future purchase credit or for a refund. We guarantee you will be satisfied with the quality of the product you ordered, or your money back in full. How to Make a Return

 

  1. Obtain a Return Merchandise Authorization (RMA #) by contacting a PaolosGelatoGourmet.com Customer Service Representative by calling 1.843.747.7377  or by email at sales@paolosgelatogourmet.com

  2. Write us the reason for your return and include it, together with all the original documents received from PaolosGelatoGourmet.com (Invoices, Packaging Slips, etc) with your return.

  3. Return to the address below (note, you will have to pay for shipping of all products sent for return, exchange or replacement, unless PaolosGelatoGourmet has first approved the return shipping charges and has sent you a return shipping label). You must fully insure your return shipment as PaolosGelatoGourmet.com is not responsible for any risk of loss and/or damage to products being shipped for return, exchange or replacement. Please use a carrier that is able to provide you with proof of delivery, such as UPS or FedEx:

All returns are typically processed with 1 business day of receipt. If you have requested an exchange, your item will be shipped out the same day your return is processed. If you have requested a refund, and your request meets the terms of our refund policies, you will be refunded by the same method you used to pay for your order. Going through the normal banking process you will typically see a refund posted to a credit card within 3-5 business days.

Damaged Products
If Customer receives damaged products, please refuse the products upon original delivery attempt. If damaged products are accepted from the carrier, such damage should be noted on the carrier delivery record. Please save the product and the original box and packaging and notify PaolosGelatoGourmet.com immediately to arrange for a carrier inspection and a pick-up of damaged products. Please notify PaolosGelatoGourmet at sales@paolosgelatogourmet.com or by calling 1.843.747.7377 of damaged products WITHIN THE FIRST 5 DAYS of receipt. Timely receipt of this information is necessary for PaolosGelatoGourmet.com to file a damage claim.

INTERNATIONAL ORDERS
We routinely ship products all over the world, and can easily accommodate orders to be shipped outside the United States.

Requirements for international orders:

  • All quotes, prices and orders will be given in US Dollars only.

  • All orders must be paid by bank wire transfer only.

  • Minimum item total must equal or exceed $500 before shipping, except orders to Canada, which have no minimum item total requirement.

  • Customer is responsible for making all shipping arrangements from our main warehouse in Charleston, SC (Paolo Gelato Gourmet , 4257 Domino Ave, Charleston, SC 29405, USA). Shipping of Canadian orders may be directly requested via our website, utilizing our FedEx shipping options.


Brokerage, duty and other fees will be the sole responsibility of the customer. We cannot predict or pre-pay these charges. Please check with your government customs officials to find out how much these charges might be prior to ordering.

WHOLESALE / DISTRIBUTOR ACCOUNTS
To make sure all of our valued customers get the best deal, we have a one price policy, which is the best price on top quality gelato supplies. Volume discounts may be available to qualified distributors, which must stock our full line of products or on an order-by-order basis for multiple orders of a single part, or orders over $1,500. If you are a licensed and established food products and/or packaging distributor or have an order that qualifies, please email your request to sales@paolosgelatogourmet.com  with quantity and description of the items needed. Please make the subject of your email or fax “Wholesale / Distribution Request” and if applicable, include a copy of your business license, your email address, fax number, and daytime telephone number. We will fax or email back a response within 2 business days. All Wholesale / Distributor orders must be in writing, either via eMail (sales@paolosgelatogourmet.com) or by sending your Purchase Order to our mailing address: PaolosGelatoGourmet.com, 4257 Domino Ave, Charleston, SC 29405, USA.

WARRANTIES
Most products are warranted against manufacturer defects for 90 days unless otherwise specified. Warranty is void if an item is altered or misused. PaolosGelatoGourmet.com is not liable for any direct or indirect consequential damage of any kind.

COPYRIGHT, LICENSES and IDEA SUBMISSIONS
The entire contents of the Site are protected by U.S. and international copyright and trademark laws. The owner of the copyrights and trademarks is PaolosGelatoGourmet.com, its affiliates, or other third party licensors. TERM; TERMINATION
This Agreement may be terminated by either party without notice at any time for any reason. The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement.

MISCELLANEOUS
This Agreement shall all be governed and construed in accordance with the laws of the State of Georgia, USA applicable to agreements made and to be performed in Georgia. You agree that any legal action or proceeding between PaolosGelatoGourmet.com and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Georgia. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. PaolosGelatoGourmet.com' failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. PaolosGelatoGourmet.com may assign its rights and duties under this Agreement to any party at any time without notice to you.

MISPRINT
PaolosGelatoGourmet.com is not responsible or obligated to honor any price or quantity misprint on the Site. Errors can and do occur despite best efforts to avoid them. Prices, quantities, product colors and terms listed on the Site are advertisements only. They are not offers to contract. Any purported purchases made by you on the Site remain subject to review and acceptance by PaolosGelatoGourmet.com.
